After sitting in the vehicle for several minutes, Deputy DAVIS alerted him
that someone was approaching the patrol unit. He stated that Deputy DAVIS
said, "Watch out, there's someone". Deputy MILLER said that Deputy DAVIS then
got out of the passenger side door and confronted the unknown person. Deputy
MILLER stated that, at this point, he could see someone standing in the
roadway. Deputy MILLER indicated that the moonlight made the patrol unit
clearly visible at the location where it was parked.

Deputy MILLER said he noticed that the subject in the roadway had a rifle in
his hands. He described him as wearing an orangish-red shirt, with dark pants.

Deputy MILLER stated that Deputy DAVIS immedialely shined his flashlight on
the subject and stated, "Hold it" or "Wait a minute" or something to that
effect. Deputy MILLER indicated that while this occurred, he immediately drew
his service pistol and pointed it at the suspect. Deputy MILLER said that
Deputy DAVIS continued to give verbal commands to the suspect, stating,
"Sheriff's Department, put the gun down". Deputy MILLER said that Deputy 
DAVIS made that statement approximately three times, at which time the suspect
then leveled the rifle and aimed at Deputy DAVIS.

Deputy MILLER indicated that this portion of the incident occurred very
quickly and, during the verbal commands and the leveling and aiming of the
rifle, he saw a muzzle flash and heard a gun shot come from the suspect' s
direction. Deputy MILLER stated that he and Deputy DAVIS returned fire. 
Deputy MILLER stated that he fired approximately two to three rounds at the
suspect. Deputy MILLER told me that he believed Deputy DAVIS and the suspect
exchanged a second series of gunfire, at which time he fired his service
pistol three to four more times. Deputy MILLER stated that, after the second
series of gunfire, everything went quiet.

Deputy MILLER stated that after the gunfire, he could not see Deputy DAVIS on
the passenger side of the patrol vehicle, and indicated that he thought Deputy
DAVIS had been shot. Deputy MILLER stated that he then grabbed the microphone
to the vehicle radio and put out an "11-99", meaning officer needs
help emergency. Deputy MILLER said that he then dropped the microphone and
retrieved Deputy DAVIS' M-16 rifle from the passenger seat area. He stated
that he then chambered a round into the weapon and got back out of the patrol
unit.

Deputy MILLER said that, at this point, Deputy DAVIS low-crawled from the
passenger side to the rear of the patrol vehicle, and then the driver's side,
meeting with him. Deputy MILLER said that he then put out another "11-99" on
the "red channel" from his portable radio. The "red channel" is a channel for
